E-P.3- NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS AND NOTICE OF DECISION REGARDING PROJECT TO BE LOCATED IN (OR THAT WILL IMPACT ON) A FLOODPLAIN OR WETLANDS November 27, 2019 Name of Responsible Entity (RE) Town of Pima, Arizona Address: 110W.Center Street City, State, Zip Code: Pima, AZ 85543 Telephone number of Preparer RE Agency 928-485-2611 REQUEST FOR RELEASE OF FUNDS On or about December 5, 2019, the Town of Pima will submit a request to the Arizona Department of Housing for the release of FY2019 CDBG funds under Title 1 of the Housing and Urban Development Act of 1974, to undertake a project known as Town Center Streets for the purpose of: A road maintenance project including crack sealing and chip-and-seal surface treatment, along portions of N 300W, N 200 W,N 100 w, Main Street 100 E,W 100 S,W and E 200 S and E 300 S in the original Pima Townsite area. Further, in order to comply with Executive Orders 11988 or 11990 and the Water Resources Council's Floodplain Management/Wetlands Protection Guidelines, the Town of Pima hereby states that this Town Center Streets project lies within an identified floodplain or wetlands (or will impact on a floodplain or wetlands). However the Town of Pima reached a decision that this is the only practicable altemative for this project. Its decision is based on an evaluation of the following altemativelsl Taking no action, leaving the existing pavement untreated. The Town of Pima will, however, ensure that this project will conform to all state and/or local floodplain or wetlands protection standards, and will take the following actions to mitigate the flood hazard/impact on wetlands and to restore and peserve natural and beneficial values: obtain and comply with all applicable permits as may be necessary The activities proposed are Categorically Excluded under HUD Regulations at 24 CFR Part 58 from National Environmental Policy Act requirements For owner occupied rehabilitation projects, pursuant to 24 CFR 58.15, a specific review of the following items will be conducted on each proposed structure to be rehabilitated prior to beginning construction, and mitigation or project denial will be implemented as necessary: Historic Preservation, Airport Clearzones, Explosive and Flammable Operations, Toxic/Hazardous Materials, Contamination, Chemicals or Gasses and Lead Based Paint. An Environmental Review Record (ERR) that documents the environmental deteminations for this project is on file at 110W.Center Street, Plma AZ 85543 and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M PUBLIC COMMENTS Any individual group, or agency may submit written comments on the ERR to the Town Hal, attn: Tavia Raley, Administrative Assistant. All comments received by December 4,2019 will be considered by the Town of Pima prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The Town of Pima certifies to the Arizona Department of Housing that Ms. Tavia Raley in her capacity as Administrative Assistant, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Arizona Department of Housing's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Pima to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Arizona Department of Housing will consider objections to its release of funds and the Town of Pima's certification received by December 20, 2019 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certilying Officer of the Town of Pima ib) the Town of Pima has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58 () the grant recipient or other participants in the project have committed funds or incured costs not authorized by 24 CFR Part 58 before approval of a release of funds by Arizona Department of Housing: or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of emvironmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Arizona Department of Housing at 110 W.Washington Street #280, Phoenix Arizona 85007.
